Ted A. Scallet has been advising clients on ERISA issues since 1978. As an Assistant Counsel for Litigation at the US Department of Labor from 1978-1982, Mr. Scallet was the principal DOL attorney on some of the most well-known cases in the ERISA jurisprudence, including Donovan v. Dillingham, Donovan v. Cunningham, Shaw v. Delta Airlines, Inc. etc.
Mr. Scallet has been representing private sector clients on litigation and DOL enforcement matters for more than 30 years. He has litigated fiduciary responsibility cases involving ESOPs, investment in collateralized mortgage obligations, the fiduciary duty to disclose, stock drop allegations, and service provider fees, among many other subjects. He is a recognized expert on preemption issues, especially in the areas of health care and affinity programs. In the past five years, he has tried six cases to verdict in courts all over the country.
Since 2000, Mr. Scallet has been the leading expert on the use of alternative financing arrangements for employee benefits, most notably in the use of captive insurance companies to fund benefit plans. He obtained the first DOL exemption for captive insurance funding and has subsequently worked with major insurers, brokers, risk managers, associations, and more than ten Fortune 500 companies in this area.
