Health and Welfare Plan Design

When designing health and welfare plan offerings, it is critical to work with an advisor who not only has the experience and capacity to consider the full range of legal issues, but also the creativity necessary to develop a design to achieve all of a client's goals.  Our attorneys advise clients on the structure of employee benefits packages and products, addressing issues such as maximizing tax advantages, maximizing benefits of key employees, integrating plan benefits with Medicare, and complying with fiduciary best practices and prohibited transaction rules.  Our intimate knowledge of and involvement with all kinds of benefits places us in the best position possible to be able to counsel our clients as to the benefit offerings and product structures that will meet their stated goals.  We have extensive experience with:

  • All types of health benefit programs, including major medical, retiree medical, consumer directed accounts (e.g., health savings accounts (HSAs), health reimbursement arrangements (HRAs), and health flexible spending arrangements), dental, vision, and hospitalization.
  • The full range of welfare benefits, including accident, disability, long-term care insurance and various life coverage options, as well as dependent care assistance, adoption assistance, educational and tuition assistance, vacation, sick and other paid and unpaid leave plans, severance, legal assistance, transportation and other fringe benefit plans. 
  • Vehicles for funding contributions for health and welfare benefits on a tax-advantaged basis, including a cafeteria plan, and a voluntary employees' beneficiary association (VEBA).
