Department of Labor Regulatory Initiatives

Our attorneys maintain close contacts at government agencies to keep abreast of all regulatory and enforcement initiatives.  Examples of our relevant experience include:

  • Prepared and submitted comments on Department of Labor’s (DOL) service provider disclosure initiatives (Form 5500 and Employee Retirement Income Security Act (ERISA) section 408(b)(2) regulations) and testified at DOL hearings regarding the proposals. 
  • Worked closely with senior DOL policy makers to develop regulations and interpretations in areas such as the payment of plan expenses, the identification and prudence of plan assets, the standards for participant-directed 404(c) plans, default investment alternatives, participant investment education and advice programs, and structuring pooled investment vehicles.
  • Drafted and submitted comments to DOL's proposed regulations relating to investment advice for participants in individual account plans and individual retirement accounts, and testified at DOL hearings regarding the proposals.
  • Worked with a group of financial institutions to obtain a DOL field assistance bulletin clarifying directed trustee responsibility in connection with plans holding employer securities, thereby mitigating the risk of litigation against directed trustees.
