Taxation of Health and Welfare Benefits
In order for health and welfare benefits to be tax-free to the employee and deductible by the employer, such benefits must be offered in a manner that complies with the restrictions and limitations under the Internal Revenue Code, as well as IRS regulations and other interpretive guidance. This not only requires a thorough understanding of how each individual rule operates, but also how various sections of the Internal Revenue Code work together, and how the IRS's interpretation has evolved over time. Failure to comply with these rules exposes the employer and individual employees to taxation and related IRS interest and penalties. Our attorneys are experts in all issues related to the taxation of health and welfare benefits.
