Katie Kohn counsels small businesses, Fortune 500 companies, nonprofits, individual owners, Boards of Directors, unsecured creditors’ committees, and plan sponsors on qualified and nonqualified retirement plans, multiemployer (union) plans, and health plans, particularly in the context of bankruptcies, M&A, and corporate planning.  Katie works with clients to find practical and valuable solutions with respect to plan mergers and spinoffs, plan de-risking transactions, plan terminations, plan corrections, overfunded plans, and corporate transactions and reorganizations involving retirement and health plans.  Katie also represents clients with respect to multiemployer plan issues, and including withdrawal liability and benefits litigation.

Katie has a strong litigation background, and represents clients in federal court and arbitration relating to corporate and multiemployer benefit plans, benefits litigation, ERISA preemption, and actuarial malpractice claims.  Katie also regularly advises clients in investigations by the Department of Labor (DOL), Internal Revenue Service (IRS), and the Pension Benefit Guaranty Corporation (PBGC). 

As a former PBGC attorney, Katie is a recognized expert in PBGC matters, including PBGC’s Early Warning Program, PBGC reportable events, distress and standard termination proceedings, and termination litigation. 

Katie also advises governmental and ERISA plans on governance, administration, and funding.

Clients relied on Katie during the COVID-19 pandemic to stay on top of changing laws. For example, Katie has advised clients on pension funding relief and Paycheck Protection Program (PPP) loans brought about by pandemic-related legislation.

Prior to joining Groom, Katie was an attorney at the PBGC.  In that role, she represented the agency in civil actions and bankruptcies in federal courts across the country, including plan termination litigation, as well as in investigations of large transactions or other situations involving plan sponsors.  Katie also represented the agency in negotiations to resolve termination and other statutory liability of plan sponsors.

Katie is one of the Groom’s most active attorneys in pro bono matters, recently focusing on immigration matters, and serves on the firm’s Pro Bono Committee.

Katie regularly speaks at conferences and on webinars regarding retirement plan issues.  She is a sub-committee co-chair of the Plan Insurance and Plan Termination section of the Employee Benefits Committee of the American Bar Association Section of Labor and Employment Law.

Katie was selected by her peers to be included in the Ones to Watch, The Best Lawyers in America, Employee Benefits (ERISA) Law (2023).
