In this webinar Groom attorneys will provide an overview of the new nonquantitative treatment limitation (“NQTL”) disclosure requirements under the Mental Health Parity and Addiction Equity Act of 2008 (“MHPAEA”) added to ERISA, the Public Health Service Act and the Internal Revenue Code in the Consolidated Appropriations Act, 2021 (the “CAA”).

We will provide a high level overview of MHPAEA’s NQTL requirement, the existing disclosure requirements under MHPAEA and the new disclosure the Secretaries of the Departments of Health and Human Services, Labor, and the Treasury or a State may request. We will also address the new procedure for determinations of non-compliance and the new Congressional reports added by the CAA, as well as practical implications for health insurance issuers and plan sponsors.
