Groom principal David Levine was quoted by Law360 in the article, “4 Takeaways From Trump’s Order To Expand 401(k) Assets,” where he discussed the potential impact of the order on fiduciary decision-making and ERISA litigation trends.
“The order’s focus on curbing ERISA litigation for fiduciaries using their ‘best judgment’ is significant in that it highlights the administration’s focus on addressing the high volume of ERISA litigation,” said Levine.
According to Law360, Levine added that “the language also follows an amicus brief from the DOL in support of plan sponsors in a forfeiture suit from July that ‘aligns directly’ with the order.”
